NEW Case: Duplicate Carbon Papers Racket Busted

"Counterfeits and Pass offs” products are a serious threat to world economy and very serious issue for growing Indian economy. No industry in India is now spared of this illegal activity. The market is flooded with counterfeits and pass-offs of not only Indian but also Imported products. For companies besides loss of revenue an even greater loss is through damage to brand reputation or loss of customer loyalty caused by poor quality of these look-alike brands. The damage top your brand is higher still if the fake products are health of safety critical items. Often the product is not even copied outright, but there is an attempt to make a look-alike product that will dupe the customer into thinking that they are buying your brand or it could be that production overruns from your global supply chain are passed off as grey market products. The customer is not always a willing party. Counterfeiting is a criminal act. India has very good laws to protect your Brand but the law enforcement authorities who do work hard cannot protect your brand and gain convictions without your help. It takes a coordinated team effort to successfully prosecute the criminal who exploit your brand. Your brand is an important asset for your company and you must take a lead role in its protection.

Retailers, wholesalers and manufacturers of your products will be identified by conducting discreet investigation. Places where they stock and manufacture the counterfeit goods will be located. The main thrust of this action will be to locate manufacturers/ packers/ wholesalers of your products as once they are located and raided, the inflow of the counterfeits in the market would be curtailed. Should it be imperative to strike at retailers this would only be considered and proposed to you when there is a cluster of such retailers and such raid would result in large scale awareness to the public and act as deterrent to other would be counterfeiters.
In all cases publicity would be given both in English and vernacular print and if possible electronic Media too ONLY IF DESIRED BY YOU.

We would require your Company to appoint a Nodal Officer as
a One Point Contact for collecting information from your end and to be actioned upon. Tring Detectives staff will collect and collate information given by your contact officer which would interalia include the following.
- Available samples of the counterfeit products date and place where it was acquired.
- Source of such information if it can be made available.
- Details of any criminal or legal action taken against counterfeiters in the recent past and, if so, when and where.
- Similarity of the pirated article to the genuine product (this is to be given in the form of tabulation).
This will help give Tring Detectives, a list of suspects and at the same time help the investigating team to understand the difference between the genuine and counterfeit product.

Tring Detectives will conduct surveys to identify the area where the counterfeit product is being sold in the market. Information, if any, provided by the Company will be compared with the result achieved by our investigators during the enquiry. Efforts will be made to obtain the source of the counterfeit product and to collect tangible evidence to facilitate the next stage.

After the enquiry is complete a detailed report of the surveys carried out, along with the samples of counterfeit products, will be forwarded to you. Tring Detectives will suggest to you the type of action to be taken which will be most beneficial to your organization, i.e. Civil Action, Criminal Action or combination of both.
It is assured that all investigations carried out by Tring Detectives will be done in a very discreet manner and though the raid would be planned by the senior officer of Tring Detectives, the actual raids would be carried out by the Police and other law enforcement authorities with assistance of Tring staff. Up to the time the actual raid is carried out, the identity of the counterfeiters and their locations will not be revealed to any other agency and the Tring staff will lead the authority to the location. We will not propose conducting actual raids unless we are reasonably sure that incriminating material would be found at the premises to be raided.

During the course of enquiry it would be necessary to make pretext purchases of the counterfeit goods. All such pretext purchases made will be appropriately tagged with details given thereupon and submitted to you along with the Final Enquiry Report.
All such pretext purchases will be billed to you as actual.

After the raid has, successfully, been carried out and perpetrators booked under various sections of law, Post Raid Action would include keeping the Client Company updated regarding the status of the cases. The object of enquiry and subsequent raid action is to arrive at a logical conclusion of the case and determined efforts made to secure convictions of the perpetrators.

A major racket of manufacturing duplicate carbon papers of branded KORES (INDIA) Limited was busted by our agency.A small scale industrial unit indulging in the manufacture of "KORES-Sapphire" carbon paper was traced,which was found located in Sector-6,Sanpada,Navi Mumbai.
A successful raid was carried out on 21.01.09 by Officers & men of Turbhe Police Station with our assistance,wherein bundles of finished duplicate carbon papers,raw material,etc worth Rs.4.22 lacs was recovered from the place and the entire manufacturing unit,consisting of vatious types of huge machinery,installed therein for the purpose,was sealed by police under seizure. Four persons found in the unit,engaged in the manufacturing process of these products were arrested.
